These Terms & Conditions (“Terms”) govern the purchase, download, and use of digital image files and artworks (“Digital Products”) sold by HARMONYA LAB (“Company,” “we,” “our,” or “us”) through its website and related platforms.

By purchasing, downloading, or using any Digital Product, you (“Customer,” “you,” or “your”) agree to be legally bound by these Terms.

1. Nature of the Products

All products sold are digital image files delivered electronically. No physical item will be shipped.

Upon successful payment, the Customer receives access to download the purchased Digital Product for personal use, subject to the license described below.

2. Intellectual Property & Copyright

All Digital Products remain the exclusive intellectual property of HARMONYA LAB and are protected under:

  • United States copyright laws
  • French intellectual property laws
  • International copyright treaties and conventions

The purchase of a Digital Product does not transfer ownership of the artwork or its copyright.

3. License of Use (Personal Use Only)

Upon purchase, HARMONYA LAB grants you a non-exclusive, non-transferable, non-sublicensable license to:

  • Download the file
  • Print the image for personal use
  • Display the image in a private, non-commercial environment (home, office, personal space)

You may not:

  • Resell, redistribute, share, gift, or sublicense the file
  • Use the image for commercial purposes
  • Modify, edit, or create derivative works
  • Use the image for marketing, branding, advertising, NFTs, AI training, or resale in any form
  • Upload the file to public platforms, print-on-demand services, or stock websites

Any unauthorized use constitutes copyright infringement.

4. Prohibited Uses

The following uses are strictly prohibited:

  • Commercial exploitation of the image
  • Use in logos, trademarks, or brand identity
  • Use in digital templates for resale
  • Sharing the download link or file with third parties
  • Mass printing or resale of printed versions

5. Payment & Pricing

All prices are listed in [USD / EUR] and are payable in full at the time of purchase.

HARMONYA LAB reserves the right to modify pricing at any time without prior notice.

6. No Refund Policy (Digital Goods)

Due to the nature of digital products, all sales are final.

Once a file has been downloaded or made available, no refunds, exchanges, or cancellations will be granted, except where required by applicable law.

7. File Quality & Printing Responsibility

HARMONYA LAB provides high-resolution files suitable for professional printing. However, the final print result depends on:

  • The printer used
  • Paper or material selection
  • Printing settings

We are not responsible for print quality issues arising from third-party printing services.

8. Limitation of Liability

To the fullest extent permitted by law, HARMONYA LAB shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits, data, or business
  • Improper use of the Digital Product
  • Printing results or color variations

Our maximum liability shall not exceed the purchase price of the Digital Product.

9. Governing Law & Jurisdiction (US & France)

These Terms are governed by and interpreted in accordance with:

  • The laws of the United States for international customers
  • The laws of France for customers located within the European Union

In the event of a dispute:

  • EU customers fall under French jurisdiction
  • Non-EU customers fall under applicable US jurisdiction

Both parties agree to seek amicable resolution before legal action.

10. Consumer Rights (EU Customers)

If you are located in the European Union, you expressly agree that:

  • By downloading the Digital Product, you waive your 14-day withdrawal right under EU consumer law, as the digital content is delivered immediately.

11. Account Security & Download Access

You are responsible for maintaining the confidentiality of your download links and files. HARMONYA LAB is not responsible for unauthorized access resulting from file sharing.

12. Modifications to the Terms

HARMONYA LAB reserves the right to update or modify these Terms at any time. Continued use of the website or products constitutes acceptance of the updated Terms.
